Introduction

The General Directorate for the Regulation of Prison Affairs, as the final authority in the implementation of criminal and executive policy, bears a great responsibility for the rehabilitation and training of offenders, their reintegration into society, and the prevention of recidivism.

This task is among the most challenging duties faced by governments around the world, and Afghanistan is no exception to this rule.

Within the framework of its duties and responsibilities, this Directorate has carried out significant activities, which are outlined below.

Strategic Objectives of the Directorate:

The reform and implementation of the Strategic Plan of the General Directorate for the Regulation of Prison Affairs have been designed to achieve the following goals:

  1. Ensuring the Islamic and fundamental rights of prisoners.
  2. Establishing a responsive structure and a transparent process of accountability.
  3. Taking measures to prevent organized crime and the development of criminal economies within prisons.
  4. Constructing essential and standard infrastructure for prisons.
  5. Reducing the financial burden of prisons on the national budget and moving them toward self-sufficiency and self-support.
  1. Part One: Activities of the Directorate’s Office for Receiving Clients
  2. The Office for Receiving Clients of the General Directorate for the Regulation of Prison Affairs has been established with the purpose of reviewing and processing clients’ requests and documents in an organized, prompt, and transparent manner.
  3. This office operates daily in several key areas, detailed as follows:
  4. Petitions Section:

This section is responsible for receiving and processing petitions submitted by clients. The subjects covered include:

  • Requests for the transfer of prisoners from one prison to another.
  • Issues raised by prisoners, such as health-related concerns or requests to meet with family members and friends.
  • Petitions referred by relevant courts concerning the handover or retrieval of clients’ property.

Other miscellaneous and case-specific petitions.

Work Procedure:

  1. Clients prepare their written petitions and submit them to the Office for Receiving Clients.
  2. The receiving staff review the petitions, and after examination, forward them to the Petitions Management Department of the Directorate’s main office.
  3. Petitions Management:
After a thorough assessment, the Petitions Management Department forwards the matter to the competent authority for the issuance of the necessary order.
  4. Once the order is issued, the Petitions Office records it in a special register and then delivers it to the relevant clients.
  5. Afterward, the petitions are followed up and implemented by the concerned department until the final stage.
  6. Inquiries Section:
  • Clients submit inquiries or requests from various institutions to the Directorate’s Office for Receiving Clients.
  • The Receiving Office accepts these inquiries and forwards them to the Petitions Section.
  • After review and evaluation, the inquiries are recorded in a special register and are officially sent to the relevant department for implementation.
  • Additionally, clients are referred to the concerned section to be informed about the execution and outcome of their inquiries.
  1. Release Documents Section:
  • Clients who receive release letters from the courts first report to the Office for Receiving Clients.
  • The receiving staff record the release letter in the client register, noting the exact date, hour, and minute.
  • The letter is then forwarded to the relevant department for official registration.
  • After registration, the concerned department sends the letter to the Executive Section.
  • Once the final order is issued, the Office for Receiving Clients hands over the letter to the relevant department in the presence of the client, and the practical procedures for the prisoner’s release are carried out by that department.
  1. Other Miscellaneous Tasks:
  • Providing clients with precise and comprehensive guidance at various administrative stages.
  • Performing other related tasks in accordance with the applicable procedures and regulations.

  • Provision of adequate and orderly seating so that clients can wait comfortably until their tasks are completed.
  • Recording the exact time and date of document submissions in a dedicated client registry book.
  • Timely and uninterrupted processing of letters, inquiries, and petitions to ensure clients do not have to wait until the next day and that their requests are handled promptly.

Part Two: Directorate for Coordination with Judicial and Legal Institutions
Services for Prisoners

  1. Release of Prisoners:
Prisoners who have completed the term set by the court, or whose sentences have been reduced by the respected authority of the Supreme Court, are released from detention.

Additionally, defendants whose previous detention is deemed sufficient for their sentence by the court, or who are declared innocent due to lack of evidence, have their release letters prepared by the respective courts.

These letters, after being signed by the general courts of the four zones, the Kabul Court of Appeals, and the Kabul Zone Military Court, are delivered to the Prison Affairs Directorate either through the prisoners’ relatives, administrative transfer personnel, or postal services.

To prevent forgery and tampering, copies of the release letters are also shared via WhatsApp by the respective courts with the Head of Coordination with Judicial and Legal Institutions.

Subsequently, the Prison Affairs Directorate submits these letters to the mentioned directorate after registration and verification. The directorate, following careful evaluation and verification of the information provided by the court, sends them for legal execution to:

  • Kabul Province Prisons and Detention Centers,
  • Pul-e-Charkhi Central Prison,
  • Juvenile Correction and Rehabilitation Center,
  • Kabul Women’s Prison, and
  • Specialized Prison for Narcotics.
  • Prisoner Transfer and Relocation Procedures:
  • Prisoners who request a change of detention facility, either through a formal petition or at the request of their relatives, are transferred to the relevant provinces under the directive of the respected authority of the Prison Affairs Directorate. This is done following careful evaluation by this department and in accordance with the official transfer procedures.
  • Prisoner transfers are carried out based on the national identity card or the municipal certification of the prisoner’s current residence.
  • File Transfer Procedures:
  • According to Article 11 of the Principles of Law, if the case files of the accused need to be transferred from the court of one province to another due to jurisdictional requirements, this process is carried out based on the request of the courts and the directive of the competent authorities.
  • The Directorate for Coordination with Judicial and Legal Institutions takes prompt and necessary actions to ensure the transfer of the accused and their participation in judicial sessions.
  • Transfer of the Accused to Court Sessions:
  • Accused individuals and prisoners who are summoned by the court to attend judicial sessions are transferred to the respective courts under the supervision of the prison’s official guards.
  • The sessions are conducted in the presence of both the defendant and the plaintiff, and verdicts are issued. However, sometimes the written verdict does not reach the Directorate of Prison Affairs on time.
  • In such cases, the Directorate for Coordination with Judicial and Legal Institutions sends separate official letters to the provincial courts to ensure that the necessary measures are taken for the delivery of the verdicts.
  • Requesting Decisions from Courts:
  • The courts request decisions from the four zones of Kabul city, its districts, the Kabul Provincial Court of Appeal, and the Central Appellate Authority.
  • Handling Accused and Prisoners Without Court Summons:
  • Accused individuals and prisoners who have not been formally summoned by the relevant courts for judicial sessions, according to the procedural law, are sent from detention centers and central prisons to the Directorate for Coordination with Judicial and Legal Institutions. This is done to track their unresolved cases and determine their legal status. The Directorate communicates this matter to the relevant courts through separate official letters, so that a lawful request for court session participation can be issued.
  • Processing Decisions for Summoned Prisoners:
  • Prisoners and accused individuals who have been summoned by the courts and for whom decisions have been issued receive part of the verdicts through the respective courts and the other part via the Kabul Criminal Investigation Directorate and the Ministry of Interior’s Criminal Investigation Department. These decisions are then forwarded to the Directorate for Coordination with Judicial and Legal Institutions for implementation. After careful verification and confirmation of the prisoners’ presence, the Directorate sends the decisions to the relevant prison and detention authorities for execution.
  • Medical Transfers for Prisoners:
  • Prisoners and accused individuals whose medical needs cannot be met by provincial hospital facilities are transferred to provincial hospitals based on recommendations from provincial doctors and the Directorate of Prison Affairs’ Health Officer for proper treatment. After treatment and examinations are completed, they are returned to their prisons. If provincial hospital facilities are insufficient, patients are transferred to central hospitals based on doctors’ recommendations for specialized care.
  • Legal Assistance for Indigent Prisoners:
  • Prisoners and accused individuals who lack financial resources and cannot hire a defense attorney are identified by the Directorate for Coordination with Judicial and Legal Institutions. Based on their petitions, the Directorate sends official letters to the Ministry of Justice of the Islamic Emirate of Afghanistan to appoint legal assistants for them. To ensure better coordination and support, a representative from the Ministry of Justice is assigned to work within the Directorate.

Services for Clients and Dependents

  1. Some citizens who were previously detained by judicial and investigative authorities due to criminal offenses, and sentenced by the courts of the former government, were later released from prisons during the Islamic Emirate’s takeover, or those who completed their sentences according to court rulings and were subsequently released, visit the relevant authorities to obtain passports, nationality IDs, and employment documents.

To ensure accurate verification of their responsibility or non-responsibility and to prevent unnecessary delays for these clients, the Directorate for Coordination has established a comprehensive nationwide database for all prisoners, accused individuals, and detainees. When a responsibility inquiry is received through the Ministry of Interior’s Criminal Technical Directorate, the Directorate provides a precise response in a short time and forwards it to the relevant authorities.

2- Timely Response to Clients’ Requests and Petitions

Some clients approach the Directorate for Coordination to resolve issues related to their detained relatives. Their petitions—including requests for prisoner transfers, retrieval of property or vehicles, verification of a prisoner’s presence or absence, and inquiries for the issuance of court rulings or information via the Kabul Province Legal Directorate and the Kabul Zone Documentation Court—are examined and acted upon in accordance with the directives and procedures of the competent authorities.

3- Listening to Concerns and Providing Proper Legal Guidance

Clients and relatives who approach the Directorate for Coordination of Judicial and Legal Institutions seeking information or advice regarding their detained family members are served through the directorate’s professional conduct and sound legal guidance, ensuring that their concerns are heard and their satisfaction is achieved.

4- Sharing Information Regarding Detainees (Criminal Cases, Supervision Dates, Imprisonment Duration, and Release Dates) from Central and Provincial Prisons:

Clients and relatives seeking information about the presence of their detainees, the nature of their crimes, supervision dates, length of imprisonment, remaining sentence, and release dates receive the necessary information from central and provincial prisons through the Directorate for Coordination of Judicial and Legal Institutions, ensuring that clients are fully informed and satisfied.

5- Cooperation in Locating Missing Detainees and Coordination with Central and Provincial Prisons:

Clients and relatives seeking information about the presence and status of their detainees contact the Coordination Directorate. This directorate requests the necessary information from central and provincial prisons. If the detainee is located, accurate information is provided to the clients, ensuring their satisfaction.

6- Support for Clients Traveling from Remote Provinces for Visits:

Clients coming from distant provinces to visit their detainees, but facing difficulties due to the unavailability of a confirmed visiting date, are assisted by the Coordination Directorate. If the visitors are close family members of the detainee (father, mother, spouse, son, or daughter) and have not yet visited the detainee, the Coordination Directorate provides them with a visiting pass.

However, visitors coming from Kabul province or nearby provinces, whose visiting date is already scheduled or who have already visited the detainee once or twice, are not considered eligible for special visitation support.

If these visitors have no prohibited items (such as clothing or other belongings) inside the prison, the items they bring are voluntarily handed over to the Coordination Directorate staff and are quickly delivered to the detainees, ensuring the visitors’ peace of mind.

7- Provision of Accurate Information upon Request:

The Coordination Directorate provides precise information regarding detainees and accused individuals—such as their presence or absence, the nature of the crime, the date of supervision, and the respective prison—based on requests from the courts, registration and documentation departments, the Kabul City Legal Affairs Directorate, provincial legal authorities, and other relevant institutions.

  • Behavioral section: Includes the inmate’s conduct with authorities and other inmates, adherence to rules and regulations, obedience, and avoidance of conflicts or fights.
  • Educational and vocational section: Tracks progress in religious, modern, and vocational education.

In-person Visit:
A direct meeting between the inmate and their relatives or defense lawyer takes place in a specifically designated area, under the supervision and security measures enforced by the prison authorities.

In-person Visit Schedule:
Each inmate is allowed to meet with the relatives listed in their file three times per month. These visits are scheduled by the prisons in the central and provincial facilities on two designated days each week and take place from 9:00 AM to 3:00 PM.

Private Visits:
Married inmates are allowed to have private visits with their legal wives, provided they possess a valid Sharia marriage certificate. If the certificate is not available, the inmate may obtain a special visit form from the prison.
